Terms of Service
These are the rules of the Tenon service: what we do for $279/month, what you give us, how to stop, and what you keep when you do. They are written to be read, not to be skipped.
- No minimum term
- Free mockup first
- Yours at month 12
- No results promised
The short version
- You get everything in the plan for one price, $279/month, with nothing held back for a higher tier.
- Free mockup first. You pay nothing until you approve the design.
- No minimum term, cancel any time. 14-day money-back after launch.
- Domain in your name from day one. Site and content yours at month 12.
- We do not promise rankings, leads, calls or revenue. Nobody can.
This summary is here so you can read the deal in ten seconds. It is not the agreement. The sections below are, and where the two differ the sections below win.
1. Who this is between
You and two people trading as Tenon
These terms are between you, the person or business buying the service, and Zachary Aqqua and Younes Berlamani, two individuals working together under the name Tenon.
Tenon is not a registered company. There is no limited company, no corporation and no shareholders behind it. You are contracting with two people, and you are entitled to know that before you hand over money, so it is the first thing on this page.
You accept these terms when you approve a design and the plan starts. Nothing needs to be signed. Our FAQ says there is no contract, and what that means is this: no minimum term, no notice period and no document to sign. These terms are the standing rules of the service, not a commitment to stay.
2. The free mockup
It costs nothing and ties you to nothing
See your homepage in 24–48h before any payment.
No payment, no card and no obligation. If you do not like it, say so and walk away. You keep the thinking: what we showed you about your own business is yours to act on, with us or with anyone else.
What you do not get by walking away is the design itself. Until a plan starts, the mockup we made stays ours: the files, the layout and the build. We may reuse the work. That is the trade for designing a real homepage for a business that may never become a client, and it is why the mockup can be free at all.
3. What you give us
Your details, and your word that they are yours
To build the site we need these from you. We can start with less and fill gaps as we go, but the site cannot go live without the basics.
- The services you sell and what they cost, or a starting figure
- The towns and areas you cover
- Your opening hours
- A phone number and an email address we can publish
- Your logo, if you have one
- Photographs of your work, if you have them
By sending us any of it you are telling us two things. First, that it is accurate: the prices, the areas, the hours and the claims about your business are true as far as you know. Second, that you own it or have permission to use it.
That second one matters more than it sounds. A photograph taken from another company’s website, a logo someone else designed and was never paid for, or a stock image without a licence all become a problem on a public page with your name on it. If you are not sure whether you have the right to use something, tell us and we will find something you do have the right to use.
If we are told that something you gave us infringes someone else’s rights, we will take it down first and ask questions after. That is not us taking a side, it is the only safe order to do it in.
4. What the price covers
$279/month, everything in it
This list is the same list as the pricing section on the home page, because it is read from the same place. If the plan changes, both change together.
- A website that gets you found, live in 7 days, fast on a phone, one page per service
- Every call you cannot take is answered live by an assistant that takes the details and emails them to you
- A review request after every job, plus 50 tap-to-review cards for the truck
- A chat that answers price and availability questions at 9pm
- Google Business Profile and local SEO for the towns you actually drive to
- Hosting, security, backups and edits, and the site is yours at month 12
- Support seven days a week, answered within the hour by the person who built your site
Prices in USD. The website becomes yours at month 12. You can host it anywhere and take it with you whenever you want.
5. Payment
Monthly, in advance, first payment on approval
Free mockup first. You pay nothing until you approve the design.
After that the plan is billed monthly in advance. Each payment covers the month ahead, and the date you approved the design is the date your month turns over.
If a payment fails we will email you and try again. Nothing happens immediately: a card expires, a bank declines, these things get sorted out. If an account stays unpaid we may pause the service, which means the website stops being served and the assistant stops answering, until it is settled. We will always tell you before that happens, never on the same day the payment failed, and your content and your domain are not touched.
Prices are in USD.
6. Cancelling
Stop whenever, and here is exactly what you keep
No minimum term, cancel any time. 14-day money-back after launch.
Email [email protected] and tell us you want to stop. There is no notice period and no cancellation fee. The service runs to the end of the month you have already paid for, and then it ends. We do not refund part of a month, apart from the money-back guarantee below.
Not happy after launch? Full refund, no questions. That is fourteen days from the day your site goes live.
This is the part people get wrong, so plainly:
- Your domain is yours, always. It is registered in your name from day one, so cancelling does not touch it and you can point it anywhere.
- Your content is yours, always. The words, the prices and the photographs you gave us were never ours.
- Before month 12, the website does not transfer. If you stop at month 7 you do not take the site with you. That is what the month 12 date means, and it is the reason the monthly price is what it is.
- The call answering, the review requests and the chat stop. They are a running service, not a thing you were buying a copy of: they run on a phone line and call minutes that are paid for monthly.
If stopping early is a real possibility for you, the outright option is the better shape of deal. $2,990 once and the website is yours, host it anywhere. The call answering, review and chat system is $129 a month on top, because it runs on a phone line and call minutes we pay for every month. Or skip it entirely and just take the site.
7. Month 12
What transfers, and what does not
After twelve paid months the website becomes yours. You can host it anywhere, change it yourself, or hire someone else to. We will hand over the files and the logins and help you move it.
What transfers to you
- The website files: the pages, the layout and the code we wrote for your site
- The text and the images we wrote or made for you
- The content you gave us, which was yours the whole time
- Your domain, which was already registered in your name on day one
What does not transfer
This is where arguments start, so it is written down before there is anything to argue about.
- Any service you have not contracted for in your own name, including hosting, the chat and the call answering. Those keep running only while the plan runs
- Any phone number we provisioned for forwarding or for the assistant to answer on. Your own business number is yours throughout and is not affected
- Any stock photograph, icon or font whose licence cannot be transferred. We will tell you which ones those are and what it costs to license them in your name
- The internal tooling and templates we build every site on, which are not part of your site
If you want to keep the call answering, the review requests or the chat running after the website transfers, they carry on as a separate monthly service. $2,990 once and the website is yours, host it anywhere. The call answering, review and chat system is $129 a month on top, because it runs on a phone line and call minutes we pay for every month. Or skip it entirely and just take the site.
8. Services we do not control
Some of this runs on other people's systems
Your site is hosted by a hosting company. The assistant answers over a real phone line, using call minutes bought from a carrier. The chat runs on a provider’s system. Your Google Business Profile belongs to Google. We chose all of them and we will move you if one of them stops being good enough, but we do not run any of them.
When one of them has an outage, your site or your call answering can go down with it, and we cannot fix it any faster than they can. We will tell you what is happening and chase them. We are not liable for their failures, and an outage on their side is not a breach of these terms by us.
One thing we do not offer at all today is automated text messaging. It is not part of the price and no date is promised for it. Sending automated texts from a US business number needs carrier registration under a registered business, which is an approval process rather than a setting. If that changes, it will be announced when it actually works, and these terms will be updated at the same time.
9. Results
We do not guarantee results, and nobody honestly can
This is the most important section on this page. Read it even if you skip the rest.
We sell a website that is built to get found, and an assistant that answers the calls you cannot take. We do not sell a number of leads, a position on Google, a percentage of calls recovered or an amount of revenue. We do not promise any of those, and nothing on this website promises them either.
Where you rank depends on Google, on your competitors, on your reviews, on how long your business has existed and on a hundred things none of us can see. How many people call depends on demand in your town, on the season, on your prices and on the weather. How many of those calls turn into jobs depends on you. Anyone who promises you a ranking or a number of leads is either guessing or lying.
So: no specific outcome is promised, guaranteed or implied. Nothing in our marketing, on our home page, in an email from us or in a conversation with us is a guarantee of results, and none of it forms part of this agreement. The things we do guarantee are written on the pricing page and repeated here: a free mockup first, a published price, no minimum term, fourteen days of money back after launch, and the website becoming yours at month 12.
10. Acceptable use
What the service may not be used for
- Do not use the site or the assistant for anything unlawful
- Do not use them to contact people who have not agreed to be contacted, where their agreement is required
- Do not use them in a way that breaks the rules of the phone carriers, Google, or any other platform the service runs on
- Do not ask us to publish claims about your business that are not true
If any of this happens we may suspend the service, and for something serious we may end it. We would always rather talk to you first, and we will, unless the thing itself makes that impossible.
11. Reviews
Every customer gets asked, the same way
You keep your own number and answer it yourself when you are free. Reviews land on your Google profile, not ours.
The review request goes to every customer after every job, with the same link, in the same words. We do not screen people first, we do not send happy customers to Google and unhappy ones to a private form, and we will not set that up for you if you ask.
This is not us being difficult. Asking only the customers you expect to be positive breaks Google’s policies, and profiles that do it get their reviews removed or the profile suspended. The downside of asking everyone is that you occasionally hear something you did not want to hear, usually before Google does, which is worth more than the review would have been.
By using the review system you agree not to ask us to filter who gets asked.
12. Who owns what
Before the transfer, after it, and our portfolio
What you gave us stays yours from the start: your name, your logo, your photographs, your words and your domain. We never claim any of it.
What we made stays ours until the transfer: the design, the build and anything we wrote or drew for you. At month 12 it becomes yours, as set out above. The tools and templates we build every site on stay ours permanently, and are not part of what transfers.
We may show your finished site in our portfolio and in our own marketing, with your business name and a screenshot or a link. If you would rather we did not, email [email protected] and we will take it down. You do not need a reason.
Our own demo pages are a separate thing and are labelled as such. Demos are Tenon concept builds; the Shah's Halal page is an unofficial concept, not their official site. They are our work, shown as concepts, and nothing in them implies that the businesses shown are clients or endorse us.
13. Liability
What we are responsible for, and the limit on it
We will do the work carefully and fix what we get wrong. If we cause you a loss and it is our fault, we will put it right or pay for it.
There is a limit. Our total liability to you for anything connected with this service is capped at the total fees you paid us in the twelve months before the claim. If you have been with us four months, that is four months of fees.
We are not liable for indirect or consequential losses: lost profit, lost business, lost bookings, lost data, lost goodwill or the cost of a replacement supplier. We are also not liable for outages at the hosting company, the carrier or the chat provider, as set out above.
Nothing here tries to exclude liability that cannot legally be excluded, including for death or personal injury caused by negligence, or for fraud.
14. Content you supplied
If what you sent us causes a claim
If someone brings a claim against us because of content you gave us to publish, you cover us for it: the claim itself, the damages and the reasonable legal costs of dealing with it.
In practice this is about photographs and text. If a photographer finds their picture on your site, or a competitor objects to a claim you asked us to publish about your business, that is yours to answer because it came from you. It does not cover anything we made up or anything we published after you told us not to.
15. Changes
How these terms change
We may update these terms. When we do, we change the effective date at the bottom of this page, and if the change is material we email you at least 30 days before it takes effect.
If you do not want to accept a change, cancel before it takes effect. There is no minimum term, so that costs you nothing beyond the month you have already paid for. Carrying on after the date counts as accepting the new version.
16. Governing law
New Mexico, United States
These terms are governed by the laws of New Mexico, United States, and the courts there are where a dispute is heard.
We work from outside the United States and serve clients in United States, Canada and Europe. Naming a forum here is meant to give you somewhere clear to go, not to make it hard. Before anyone goes anywhere, email us: almost everything is a misunderstanding that a phone call fixes.
